What is ECA?
The concept of Early Case Assessment (ECA), in its most broad and traditional expression, is an assessment not only of the information available but also of the risks of going forward to trial. It would also include assessment of costs. As the costs associated with assessment of information, particularly ever increasing amounts of ESI, have increased dramatically, those considerations have tended to dominate ECA. Perhaps they would better be denominated more narrowly as Early Data Assessment or EDA.
Without tools for technology assisted review, ECA is a series of activities, largely technologically based, which:
- Fix the sources of information (custody) contained in the prospective data set;
- Legitimately limit the amount of content that must be professionally reviewed. (In other words, what can be discarded or excluded without actually reading the information);
- Initially organize the information in the data set for orderly review; perhaps to a work flow.
Xpriori ECA Technology to Speed a First Cull
From the Content Map information, Xpriori professionals use the Xpriori First Cull tool to do a preliminary assessment as to the scope and type of content and to identify email senders, recipients and date ranges to lead to an orderly organization of the actual emails loaded to the data set. This assessment is the initial Data Inventory. The Data Inventory is a living document to which information will be added and deleted during the process.
First Cull enables a first cull without looking at the content and with the goal of eliminating all files which could not possibly contain content of interest. From any computer on the network, or with an easy load to a desktop/laptop, Xpriori professionals gain information about the files and file types, email information about senders, receivers, dates, dupes and subjects, and files which may need special handling – all before looking at content and before making transfers to the discovery platform. The goal is to significantly reduce the number of files which will require content review or even be loaded to the eDiscovery repository.

The ultimate deliverable from ECA – prior to content review -- is a useful repository of information for such review. Xpriori can deploy to three separate repositories, each to cover the special needs of the client:
Xpriori hosted OrcaTec Document Decisioning Suite for larger collections of documents – in fact, it can be millions of documents – to gain the full range of technology assisted review capacities. The documents, once loaded are available for continued analysis and also for revised analysis with the addition of new documents to the dataset.
Nexidia for audio based files – again, the documents, once leaded, are available for continued use.
XCM Discovery Appliance for the automated copy and transfer files to its repository where the following takes place: (1) metadata is carried forward and indexed; (2) all text documents are indexed for free text search; (3) documents requiring OCR are OCR’d. The files once loaded are available for continued use.
The repository used to contain the raw material to support the case and is used iteratively by reviewers as the case moves forward.
